Welcome. These Terms of Use govern your use of haywoodfamilyeye.com (the "Site"), operated by Haywood Family Eye Care, O.D., PLLC ("HFEC," "we," "our"). Please read them — they are short, plain, and important. By using the Site, you agree to them. If you do not agree, please do not use the Site.
What this Site is for
The Site is informational. It tells you about our practice, our doctors, our services, and our office, and it lets you book an appointment, contact us, and read articles about eye health. That is its purpose.
No doctor-patient relationship
Reading this Site does not make you our patient. Submitting a contact form, booking an appointment online, or reading a blog post does not, by itself, create a doctor-patient relationship. That relationship begins when you come into our office for an exam and we agree to provide care.
Not medical advice
Articles, FAQs, and information on this Site are provided for general education. They are not a substitute for a comprehensive eye exam by a licensed optometrist or ophthalmologist. Do not delay seeking care, ignore symptoms, or change a treatment plan because of something you read here.
If you have an eye health concern — sudden vision change, eye pain, flashes, floaters, an injury, or anything else that worries you — call our office at (828) 456-8361. If you are having a medical emergency, call 911 or go to your nearest emergency department.
Acceptable use
Use the Site for its intended purpose. Do not:
- Try to gain unauthorized access to any part of the Site, our servers, or any connected systems.
- Use automated tools to scrape, copy, or overload the Site.
- Submit false information, impersonate someone else, or interfere with another user.
- Use the Site to send unsolicited messages, malware, or anything illegal.
- Reproduce or redistribute Site content for commercial use without our written permission.
User-submitted content
The Site does not currently host comments, forums, or other user-submitted content. If we add features that allow you to submit content in the future, you grant us a non-exclusive license to use what you submit for the purpose of operating the Site, and you confirm that you have the right to share it. We may remove anything we judge to be inappropriate or unlawful, at our discretion.
Intellectual property
The Site's design, text, graphics, logos, photographs, and software are owned by HFEC or our licensors and are protected by U.S. and international copyright and trademark laws. You may view, print, or save Site content for your own personal, non-commercial use. Anything beyond that requires our written permission. The "Haywood Family Eye Care" name and our logos are our trademarks.
Third-party links and services
The Site links to third-party services we use — online scheduling (ScheduleYourExam), the patient portal, contact lens reorder (Arrellio), online bill pay, Google Maps, and others. Those services are not operated by us, and we are not responsible for their content, privacy practices, or availability. Their terms and privacy policies apply when you use them.
Disclaimer of warranties
The Site is provided on an "as is" and "as available" basis. We work hard to keep the Site accurate and current, but we make no warranties — express, implied, or statutory — that the Site will be uninterrupted, error-free, secure, free of viruses, or that the information will always be complete or up to date.
Limitation of liability
To the fullest extent allowed by law, HFEC and our doctors, employees, and agents are not liable for any indirect, incidental, consequential, or punitive damages arising out of your use of, or inability to use, the Site — even if we have been told such damages are possible. Our total liability for anything related to the Site will not exceed one hundred dollars ($100). Some states do not allow these limitations, so they may not apply to you.
Nothing in these Terms limits any rights you may have under federal or state consumer protection laws, professional licensing laws, or any other law that cannot be limited by agreement.
Indemnification
You agree to defend and hold HFEC harmless from claims arising out of your misuse of the Site or your violation of these Terms. This does not apply where the law does not allow it.
Governing law and venue
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of the Site will be brought in the state or federal courts located in Haywood County, North Carolina, and you consent to the personal jurisdiction of those courts.
Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top will reflect when the current version went into effect. Continued use of the Site after a change means you accept the updated Terms.
Severability and entire agreement
If any part of these Terms is found unenforceable, the rest still applies. These Terms — together with our Privacy Policy, HIPAA Notice of Privacy Practices, Accessibility Statement, and Notice of Nondiscrimination — are the entire agreement between you and HFEC about your use of the Site.
